Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of ekzraasikoshish.org and any related services offered by Ek Zraa Si Koshish, including donation processing, volunteer registration, and event or workshop sign-up (together, the "Site"). By accessing the Site, submitting a form, or making a donation, you agree to be bound by these Terms. If you are using the Site on behalf of an organisation, you confirm you have the authority to bind that organisation to these Terms.

If you do not agree to these Terms, please discontinue use of the Site immediately.

2. About Ek Zraa Si Koshish

Ek Zraa Si Koshish is a nonprofit organisation registered in India, holding valid registration under Section 80G and Section 12A of the Income Tax Act, 1961, and registered under the Foreign Contribution (Regulation) Act, 2010 (FCRA). Our registered office is in Haridwar, Uttarakhand. We train girls and women in self-defense, life skills, and public awareness through structured programs, community workshops, and volunteer-led initiatives.

3. Eligibility

The Site is intended for use by individuals who are at least 18 years old, or who are accessing it with the involvement of a parent or guardian (for example, a guardian registering interest in a program on behalf of a minor). By using the donation or volunteer forms, you confirm that the information you provide is accurate and that you have the legal capacity to enter into these Terms.

4. Acceptable use

You agree to use the Site only for lawful purposes and in a manner consistent with its intended function. Specifically, you agree not to: submit false, misleading, or fraudulent information through any form; attempt to gain unauthorised access to the Site, its servers, or any connected systems; interfere with or disrupt the Site's functionality, including through malware, scraping at scale, or denial-of-service activity; or use the Site to harass, impersonate, or misrepresent your affiliation with Ek Zraa Si Koshish.

We reserve the right to suspend or restrict access to any user who violates this section, without prior notice, and to report unlawful activity to the appropriate authorities.

5. Donations

Donations made through the Site are processed by a third-party, PCI-DSS-compliant payment gateway. We do not directly receive, view, or store your full card, UPI, or bank account credentials — these are handled entirely by our payment processor under its own terms and privacy policy, which you should also review before donating.

Donations are voluntary contributions and are non-refundable, except in cases of duplicate charges, technically erroneous transactions, or amounts charged in excess of what you intended to donate. To request a refund on those grounds, contact contact@ekzraasikoshish.org within 7 days of the transaction, quoting your payment reference ID. Approved refunds are processed to the original payment method within 7–10 business days.

A donation receipt eligible for tax deduction under Section 80G of the Income Tax Act, 1961 will be issued to the email address provided at the time of donation, typically within 15 business days. The extent of deduction available to you depends on your individual tax circumstances; we encourage you to consult a qualified tax advisor. Where a donation is made in a currency or from a source that qualifies as "foreign contribution" under the FCRA, it will be accounted for and reported in accordance with our FCRA obligations, and may be subject to additional processing steps or restrictions under that Act.

6. Volunteering

Submitting the volunteer form is an expression of interest and does not, by itself, create any volunteer, contractual, or employment relationship between you and Ek Zraa Si Koshish. Confirmed placements are subject to a review of your application, a subsequent conversation with our team, and — for roles involving direct contact with program participants — a background and reference check. We may decline any application at our discretion, including without providing a reason, and may ask a confirmed volunteer to step back from a role where a safeguarding concern is identified.

Volunteers are expected to follow our code of conduct and safeguarding policy, details of which are shared directly with applicants during onboarding.

7. Intellectual property

All text, graphics, logos, photography, and other content on the Site, unless separately credited, are owned by Ek Zraa Si Koshish or used under license and are protected by Indian and international copyright and trademark law. You may view, download, and share Site content for personal, non-commercial, and educational purposes, including to support fundraising or awareness for Ek Zraa Si Koshish, provided you do not alter it or imply an endorsement that does not exist. Any other reproduction, redistribution, or commercial use requires our prior written consent — contact contact@ekzraasikoshish.org.

8. Third-party services and links

The Site integrates with or links to third-party services, including payment gateways and social media platforms. These third parties operate under their own terms and privacy policies, which are outside our control. We are not responsible for the availability, accuracy, or practices of any third-party service, and linking to a third-party site does not imply our endorsement of it.

9. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis. While we take reasonable care to keep information on the Site accurate and current, we make no warranty — express or implied — that the Site will be uninterrupted, error-free, or secure, or that content (including statistics about our programs) is complete or free of inaccuracy at all times.

10. Limitation of liability

To the maximum extent permitted under applicable law, Ek Zraa Si Koshish, its trustees, employees, and volunteers will not be liable for any indirect, incidental, special, or consequential loss or damage arising from your access to or use of, or inability to access or use, the Site — including loss of data, loss arising from a third-party payment processor's acts or omissions, or reliance on information published on the Site. Nothing in these Terms limits liability that cannot lawfully be excluded, including liability arising from fraud or gross negligence.

11. Indemnity

You agree to indemnify and hold Ek Zraa Si Koshish harmless from any claim, loss, or demand, including reasonable legal fees, made by a third party arising out of your breach of these Terms or your misuse of the Site.

12. Grievance redressal

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the contact details of our Grievance Officer are published below for any complaints regarding content on the Site or the use of the Site.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any mandatory consumer-protection venue rights you may have, you agree that the courts at Haridwar, Uttarakhand shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the Site.

14. Severability and entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ek Zraa Si Koshish regarding use of the Site.

15. Changes to these terms

We may revise these Terms from time to time to reflect changes in our operations or applicable law. The version in effect is always the one published on this page, dated by the "Last updated" notice above. Material changes will also be noted in our annual report where relevant. Your continued use of the Site after a revision takes effect constitutes acceptance of the revised Terms.
